  • 3. Lasting Power of Attorney

A lasting power of attorney (LPA) is a legal document that lets you (the ‘donor’) appoint one or more people (known as ‘attorneys’) to help you make decisions or to make decisions on your behalf. This gives you more control over what happens to you if, for example, you have an accident or an illness and can’t make decisions at the time they need to be made (you ‘lack mental capacity’).

There are 2 types of LPA and you can choose to make one type or both.:

    • health and welfare
    • property and financial affairs

Full details on creating a LPOA are available via

Dr Lubel can act as Certificate Provider - an important safeguard of the sytem which ensures that the donor fully understands the LPOA and is not being put under pressure to complete it.

The Care Act has finally been enacted and at long last sees the abolition of section 47 of the 1948 National Assistance Act which allowed the removal from their homes of people living in insanitary conditions, despite them having mental capacity. It was originally used to help clear the Victorian slums and hasn't been used very much in recent years.
